Anticipated duties
Individuals who have worked for the government, financial and educational institutions are familiar with a criminal background search, but for most people, the idea of being the subject of a criminal background check is a completely new experience. If an individual being considered for a position has a criminal conviction or a pending criminal charge, a company will determine if there is a substantial relationship between the offense and the new job responsibilities. The anticipated duties should be discussed with the employee, and the employee should be informed that a criminal background check is required prior to the assignment of such duties and that if the background check reveals a conviction relevant to the sensitive position, the individual should be disqualified from holding the sensitive position or having the sensitive duties assigned.
